Final Approval Granted In Johnson v. Pennsylvania Agency of NursesDecember 1, 2009
On July 7, 2008, Willig, Williams & Davidson partner Bruce M. Ludwig filed a class action lawsuit in the Court of Common Pleas of Philadelphia County against the Pennsylvania Agency of Nurses on behalf of a group of home care workers employed by that agency. The lawsuit sought overtime wages for those members of the class who worked in excess of 40 hours in a work week but were not at the rate of paid time and one-half.
A settlement was obtained in which PAN agreed to pay $244,000 into a fund to be distributed for the benefit those denied overtime wages. Distribution is being made to those eligible members of the class in December 2009. There are approximately 60 employees eligible for payment. In some cases, the amount paid is in excess of $10,000.
