Q. 63. Do I have to use the doctors on my employer's panel list for PA workers' compensation?

The Pennsylvania Workers’ Compensation Act requires that an injured worker treat with the Employer’s Panel list for the first 90 days. The employer is required to provide notice that treatment with a panel physician is required both at the time of hire and immediately after the injury. If the employer fails to provide the required notice, an injured worker can seek treatment with their own physician. The injured worker may also treat outside the panel within 90 days if the panel list does not include the specialty required to treat the injury. An injured worker should transfer their care to a physician of their own choosing as soon as the 90 day period expires. If the employer issues a Notice of Compensation Denial, indicating that the claim is not being accepted under Pennsylvania workers’ compensation, the injured worker can seek treatment with their own physician. Whether an injured worker is required to treat with a panel physician can be complicated with the specific facts of that worker’s case.

If you have questions about whether you are required to treat with the panel physician  or would like to discuss a work injury or workers’ compensation claim with us, please feel free to call Willig, Williams & Davidson and its work injury lawyers at 1-866-413-COMP (2667) or 1-215-656-3600.
