The Legal Intelligencer Interviews Labor Attorney Richard Poulson about PA Supreme Court Ruling for Firefighters' Pension Rights

The Legal Intelligencer quoted our labor attorney Richard G. Poulson, on the Supreme Court's ruling that public employers cannot unilaterally eliminate firefighters' pension benefits without collectively bargaining with a union representative first.

The justices unanimously reversed the Commonwealth Court, which had held that even though the Collective Bargaining by Policemen and Firemen Act, known as Act 111, requires public employers to bargain with union representatives over benefits, the City of Erie did not violate the act when it discontinued a firefighter pension plan because it was unclear whether the pension plan had been included in the firefighters' collective bargaining agreement with the city.

Richard G. Poulson of Willig Williams & Davidson in Philadelphia, who represented the firefighters' union in this case, said the Supreme Court's ruling "is particularly important because it reinforces employees' right to pension benefits and protects those benefits from unilateral changes by employers" at a time when municipalities across the state are under pressure to either reduce or eliminate pension plans.
