Partner Discusses Union Preparation for Upcoming Janus AFSCME Willig, Williams & Davidson partner Alaine S. Williams has been sharing her insight regarding the potentially ground-breaking U.S. Supreme Court decision expected in Janus v. AFSCME. The upcoming decision could outlaw “fair share” fees, changing a public sector union’s ability to collect agency fees to cover the costs of collective bargaining.

The impending decision has caused unions to focus on converting fee-payers to dues-paying members to avoid the loss of revenue. Speaking to Vin Gurrieri of Law360, Williams said, “Virtually all of the unions that represent public-sector workers, and at this point in time I think that includes most labor organizations, have been very proactive in trying to get out in front of this.”

In another article about Janus in Bloomberg Law, journalists Jacklyn Diaz and Louis C. LaBrecque write that the National Right to Work Legal Defense Foundation and the Freedom Foundation have seven lawsuits pending regarding the legality of “fair share fees” or agency fees.

Williams represents the Teamsters in Minnesota in one such case. Fighting NRTW since 1988, Williams explained to Bloomberg Law that regardless of any decision on Janus, opponents “will keep filing these lawsuits until well after they’re dead and buried.” Professors echoed Williams’ sentiments asserting that a ban on agency fees in the public sector could lead to a push for a ban in the private sector, as well.
