Union Member Communications: When Knowing Too Much Can Become a Problem

In general, employers cannot force private sector unions to disclose communications with members during the course of representation. The National Labor Relations Board recognized a union-member grievance privilege for private-sector employees in Cook Paint & Varnish Co., 258 NLRB 1230 (1981), and found that an employer violated the National Labor Relations Act when it threatened to discipline a union steward unless he disclosed the substance and notes of conversations with a member about an incident that could have resulted in discipline.

Workers' CompWorkers' Compensation – What to Know if You Get Hurt at Work

If you suffer an injury, as a result of an accident or repetitive activity at work, you should immediately give notice to your supervisor. You should report an injury even if you do not anticipate missing time from work. When you report your injury to your supervisor, you must give specific information that your condition was caused by your work activities. It is not enough to say you are hurt or have to go home.

Police Officer ResidencyPA Supreme Court Rejects Residency Requirement for Pittsburgh Police Officers

On May 22, 2017, the Supreme Court of Pennsylvania in City of Pittsburgh v. Fraternal Order of Police, Fort Pitt Lodge No.1 held that the city did not have the legal authority to amend its home rule charter such that it would eliminate a mandatory subject of bargaining under the Police and Firemen Collective Bargaining Act, known as Act 111.

Kentucky Labor UnionsKentucky Labor Unions Take On So-Called 'Right To Work' Law

On May 25, 2017, two labor unions in Kentucky instituted litigation in Kentucky state court seeking to strike down the state's new so-called "Right To Work" Law. As background, Kentucky only just became a "Right To Work" state in January 2017. It, along with Indiana, Michigan, Missouri, West Virginia, and Wisconsin, is among the states that became "Right To Work" in recent years, after many years of allowing unions to require non-members to pay their fair share for the benefits of union representation.

Disciplinary DecisionsNegotiating Disciplinary Decisions in Newly Organized Bargaining Units

The employees have just voted for union representation, but they do not yet have a first collective bargaining agreement. Once they have a contract, they hope that it will require the employer to show "just cause" for discipline or discharge, and include a grievance and arbitration procedure through which the union can challenge unjust disciplinary decisions. But what happens until then?
