Ryan A. Hancock, of counsel and chair of the Employment Law department at Willig, Williams & Davidson, shared his insight with Gayle Cinquegrani of Bloomberg BNA for an article entitled “Ban-the-Box Laws Reduce Role of Criminal Records in Hiring.” The article discussed the movement to forbid employers from asking potential hires about their criminal records during the initial job application process. The name of the law refers to the question and corresponding box on a job application that indicates whether the applicant has had a criminal history.

Hancock explained that Philadelphia’s version of the law allows employers to run a background check only after making a conditional job offer. Hancock recommended that Philadelphia employers consider the conviction, the amount of time that has lapsed since the conviction, the employee’s character references and the job in question when evaluating a potential employee.
