Law360 Covers NLRB’s Decision to Maintain Hospital’s Agreement with Service Employees’ Union

Service Employees International Union Healthcare Pennsylvania (SEIU HCPA) will continue to serve as the bargaining representative for services and maintenance employees working at University of Pittsburgh Medical Center (UPMC) Washington in Washington, Pennsylvania. A recent petition from hospital worker Gavin McNally sought to decertify the union as the sole representative, but the National Labor Relations Board (NLRB) dismissed Gavin McNally’s petition, finding that a valid and enforceable collective bargaining agreement existed between UPMC and SEIU HCPA. 

When the hospital became part of UPMC’s medical system in 2024,  SEIU HCPA held a series of bargaining sessions, which resulted in an agreement ratified by a vast majority of the bargaining unit in February 2025. Almost eight months later, Gavin McNally, through the anti-union National Right to Work Legal Defense Foundation, filed the petition to decertify, claiming the agreement was not a formal contract. NLRB Regional Director Tara Yoest found that the ratification vote put the agreement into effect, despite some minor non-substantive changes being made by the Parties after its initial implementation to properly reflect the tentative agreements between the Parties.
