Final Approval Granted In Johnson v. Pennsylvania Agency of Nurses

December 1, 2009

On July 7, 2008, Willig, Williams & Davidson employment law lawyer Bruce M. Ludwig filed a class action lawsuit in the Court of Common Pleas of Philadelphia County against the Pennsylvania Agency of Nurses on behalf of a group of home care workers employed by that agency. The lawsuit sought overtime wages for those members of the class who worked in excess of 40 hours in a work week but were not at the rate of paid time and one-half. A settlement was obtained in which PAN agreed to pay $244,000 into a fund to be distributed for the benefit those denied overtime wages. By Order dated December 1, 2009, the Court of Common Pleas of Philadelphia County approved the class action settlement. To view a copy of the Court’s Order, click here. Distribution is being made to those eligible members of the class in December 2009. There are approximately 60 employees eligible for payment. In some cases, the amount paid is in excess of $10,000. If you have any questions concerning this settlement or about wage and hour practices at another home care agency, contact us.
